What is the Clery Act?
The Jeanne Clery Disclosure of Campus Security, Policy and Crime Statistics Act, or the Clery Act, is a federal law that requires all U.S. colleges and universities, both public and private, participating in federal student aid programs, to maintain and disclose certain crime statistics and campus security information.
Why is the Clery Act Important?
The Clery Act was designed to assist students, parents, and other members of the campus community in making informed decisions regarding their personal safety. The Clery Act promotes transparency in crime statistics on campus, and requires institutions of higher education to make certain crime statistics public and readily available. In compliance with the Clery Act, Texas A&M University-Texarkana University Police Department (UPD) maintains a Daily Crime Log and a Daily Fire Log at the main UPD office in the Central Plant building. This log is available for review upon request. The logs note all CLERY related crimes and fire incidents. The logs are available 24-hours a day, 7 days a week. Any UPD personnel may provide you with the log upon request. The campus crime statistics, along with campus safety policies, programs, and general information is published in a yearly campus safety report. This report is available below, and a printed copy can also be requested in the main UPD office.
Clery Act Requirements
Under the Clery Act, each University must:
- Identify Campus Security Authorities (CSAs) and collect information from the CSAs about crimes that have been reported to them;
- Publish an Annual Security Report by October 1st of each year. The report must be made available to all current and prospective students and employees;
- Create, maintain, and make available a daily crime log documenting the nature, date and general location of each crime;
- Disclose statistics for reported Clery crimes that occur on campus, on public property within or immediately adjacent to campus, and in or on non-campus buildings or property that the institution owns or controls;
- Issue timely warnings about Clery Act crimes that pose a serious or continuing threat to students and employees;
- Initiate notification procedures for any significant emergency or dangerous situation occurring on the campus that involves an immediate threat to the health or safety of students or employees;
- Disclose fire safety policies and procedures related to on-campus housing and statistics for fires that occur in those facilities and maintain a fire log;
- Have missing student notification policies and procedures in place for students who reside in on-campus housing; and
- Provide programs to prevent dating violence, domestic violence, sexual assault, and stalking and adopt institutional policies for handling such alleged offenses in accordance with the Violence Against Women Reauthorization Act (VAWA) requirements.

Campus Security Authorities (CSA's)
The Clery Act defines a CSA as any of the following categories:
- A campus police department or a campus security department of an institution, e.g. any member of USC’s Department of Public Safety.
- Any individuals who have responsibility for campus security but are not members of a campus police department or a campus security department (e.g., an individual who is responsible for monitoring the entrance into institutional property, such as a security guard).
- Any individual or organization specified in an institution’s statement of campus security policy as an individual or organization to which students and employees should report criminal offense; or
- An official of an institution who has significant responsibility for student and campus activities, including, but not limited to, student housing, student discipline and campus judicial proceedings.
CSA reports are used for determining statistical data disclosed in the Annual Security Report and in the daily crime log. CSA reports are also evaluated for timely warning/emergency notification.
